Terms & Conditions

Welcome to Skyview of Africa Ltd. These Terms & Conditions govern all bookings made with Skyview of Africa Ltd. By making a booking, paying the required deposit, or travelling with us, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.


1. Booking Confirmation

A booking is considered confirmed only after Skyview of Africa Ltd has received the required deposit and issued written confirmation.

All quotations, itineraries, prices, and reservations are subject to availability until confirmed in writing.


2. Deposits & Payments

  • A 50% non-refundable deposit of the total tour cost is required to confirm and secure your booking.
  • Certain services, including international and domestic flights, luxury lodges, gorilla trekking permits, special event bookings, and peak-season reservations, may require full payment at the time of booking.
  • The remaining 50% balance must be paid 45 days prior to the commencement of the tour.
  • Bookings made within 45 days of departure require full payment upon confirmation.
  • Payments may be made via bank transfer, mobile money, or any other payment method approved by Skyview of Africa Ltd.
  • Failure to make the final payment by the due date may result in cancellation of the booking and the release of all reserved services.

3. Prices

All prices are quoted in the specified currency and are based on rates applicable at the time the quotation is prepared.

Skyview of Africa Ltd reserves the right to revise prices before final payment in the event of increases in:

  • Government taxes
  • National park and conservation fees
  • Fuel surcharges
  • Airline fares
  • Exchange rate fluctuations
  • Hotel and lodge rates
  • Supplier charges beyond our control

Any such increases shall be payable by the traveller.


4. Tour Price Includes

Unless otherwise stated in the itinerary, tour prices include:

  • Accommodation as specified.
  • Meals as indicated.
  • Ground transportation.
  • Professional English-speaking driver/guide.
  • Scheduled game drives and sightseeing.
  • Park entrance fees where included.
  • Airport transfers where specified.
  • Bottled drinking water during game drives.

5. Tour Price Excludes

Unless specifically stated, tour prices do not include:

  • International and domestic flights.
  • Visa fees.
  • Comprehensive travel insurance.
  • Optional excursions and activities.
  • Laundry services.
  • Telephone charges.
  • Alcoholic beverages and soft drinks unless stated.
  • Tips and gratuities.
  • Medical expenses.
  • Personal shopping.
  • Any items of a personal nature.

6. Passport, Visa & Health Requirements

It is the traveller’s responsibility to ensure they possess:

  • A passport valid for at least six (6) months beyond the date of travel.
  • All required visas.
  • Required vaccination certificates.
  • Any health documentation required by the countries visited.
  • Compliance with customs and immigration regulations.

Skyview of Africa Ltd shall not be responsible for denied boarding, refused entry, missed flights, or additional costs resulting from incomplete or invalid travel documentation.


7. Travel Insurance

It is the sole responsibility of every traveller to obtain comprehensive travel insurance before the commencement of their trip. Skyview of Africa Ltd does not provide travel insurance and shall not be held liable for any losses, costs, damages, or claims arising from a traveller’s failure to obtain adequate insurance coverage.

Your travel insurance should provide adequate cover for, but not be limited to:

  • Medical emergencies and hospitalization.
  • Emergency medical evacuation and repatriation.
  • Trip cancellation or interruption.
  • Personal accident and accidental death.
  • Loss, theft, or delay of baggage and personal belongings.
  • Flight delays or missed connections.
  • Personal liability.
  • Adventure and safari activities where applicable.

Travellers are strongly advised to carefully review their insurance policy to ensure it provides sufficient cover for all destinations, activities, medical emergencies, and the full duration of their journey.


8. Cancellation by the Client

All cancellations must be submitted in writing and shall only become effective upon receipt by Skyview of Africa Ltd.

Accommodation providers, airlines, safari lodges, tented camps, resorts, cruise operators, gorilla trekking permits, park authorities, and other third-party suppliers operate under their own cancellation, amendment, and refund policies.

In many cases, hotels, safari lodges, camps, and resorts do not offer cash refunds for cancelled bookings. Instead, they may issue a credit note or travel voucher, subject to their individual terms and conditions.

Where Skyview of Africa Ltd receives a credit note or travel voucher from a supplier, the same credit will be transferred to the traveller. The traveller may use the credit towards a future booking within the validity period specified by the supplier. Rebooked travel dates are subject to availability of accommodation, flights, permits, and other travel services.

Any additional costs resulting from seasonal rate changes, revised park fees, airline fare differences, taxes, currency fluctuations, or other supplier charges applicable at the time of rebooking shall be borne by the traveller.

Any cancellation fees or penalties imposed by airlines, hotels, lodges, camps, resorts, transport providers, park authorities, or other suppliers shall remain the responsibility of the traveller.

The 50% non-refundable booking deposit paid to Skyview of Africa Ltd is retained to cover reservation processing, administrative costs, supplier commitments, and other expenses incurred in arranging the travel services.

Skyview of Africa Ltd cannot guarantee that suppliers will issue refunds, credit notes, or travel vouchers and shall not be held liable where a supplier declines to do so. Any refund, credit note, or voucher issued will be governed solely by the terms and conditions of the respective supplier.


9. Amendments to Bookings

Requests to amend confirmed bookings are subject to availability and may incur additional charges imposed by airlines, hotels, lodges, transport providers, park authorities, or other suppliers.

Skyview of Africa Ltd will make every reasonable effort to accommodate requested changes but cannot guarantee availability.


10. Cancellation or Changes by Skyview of Africa Ltd

Skyview of Africa Ltd reserves the right to cancel, postpone, or amend any tour due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather conditions, political instability, civil unrest, pandemics, government restrictions, airline disruptions, security concerns, road closures, or conservation requirements.

Where practical, comparable alternatives or revised travel dates will be offered.


11. Itinerary Changes

While every effort is made to operate tours as advertised, Skyview of Africa Ltd reserves the right to substitute accommodation, alter routes, transportation, activities, or schedules due to operational requirements or circumstances beyond our control.

Comparable alternatives will be provided wherever reasonably possible.


12. Accommodation

Should an advertised hotel, lodge, camp, or resort become unavailable, Skyview of Africa Ltd reserves the right to substitute it with accommodation of a similar or higher standard.


13. Wildlife Viewing

Wildlife sightings cannot be guaranteed. Animals move freely within their natural habitats and sightings depend on weather conditions, migration patterns, seasonal changes, and natural animal behaviour.


14. Traveller Responsibilities

Travellers are expected to:

  • Respect local customs, traditions, and cultures.
  • Follow instructions from guides and tour leaders.
  • Observe national park regulations.
  • Respect wildlife and maintain safe viewing distances.
  • Protect the environment by avoiding littering.
  • Arrive punctually for scheduled departures and activities.

Any expenses arising from delays or disruptions caused by the traveller shall be the traveller’s responsibility.


15. Limitation of Liability

Skyview of Africa Ltd acts solely as an agent for airlines, hotels, lodges, transport providers, cruise operators, and other independent suppliers.

While every effort is made to ensure quality services, Skyview of Africa Ltd shall not be liable for personal injury, illness, death, loss or damage to personal property, flight delays or cancellations, missed connections, Acts of God, government actions, supplier failures, industrial action, or any event beyond our reasonable control.

Participation in safaris, excursions, mountain trekking, walking safaris, balloon safaris, water sports, and other adventure activities is undertaken entirely at the traveller’s own risk.


16. Force Majeure

Skyview of Africa Ltd shall not be liable for any failure to perform its obligations where such failure results from floods, droughts, earthquakes, fires, terrorism, war, epidemics, pandemics, government restrictions, airline strikes, civil unrest, or any other force majeure event beyond its reasonable control.


17. Photography & Marketing

Skyview of Africa Ltd may use photographs or videos taken during tours for promotional and marketing purposes unless the traveller notifies us in writing before the commencement of the tour that they do not wish to appear in such materials.


18. Complaints

Should any issue arise during your tour, you should immediately notify your guide or a Skyview of Africa Ltd representative so that every reasonable effort can be made to resolve the matter promptly.

Formal complaints must be submitted in writing within 14 days of completion of the tour.


19. Privacy Policy

Skyview of Africa Ltd respects your privacy. Personal information collected during the booking process will be used solely for processing bookings, arranging travel services, communicating with travellers, and complying with legal requirements. We do not sell, rent, or disclose personal information except where necessary to fulfil travel arrangements or where required by law.


20. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the competent courts of Kenya.


Acceptance of Terms

By paying the required deposit, confirming a booking, or participating in any tour arranged by Skyview of Africa Ltd, the traveller acknowledges that they have read, understood, and accepted these Terms & Conditions.
