Terms and Conditions for Booking African Safari with Skyview of Africa Ltd

Skyview of Africa Ltd, a KATO Member, offers the highest possible standard of service when sending you African safari quotations. The following terms and conditions shall apply when booking any of our African holidays:

1: Payment

I. A deposit of 50% or the full quoted price must be received by Skyview of Africa Ltd before the company can be regarded to have entered into any legal contractual booking with the clients.

II. The balance must reach our bank account not less than 45 days prior to the safari starting date.

III. In case where bookings are made less than 45 days before the commencement of the trip, the full payment must accompany your booking. However, Skyview of Africa Ltd can relax the requirement if there is prior arrangement with the clients.

IV. Our prices for non-residents are quoted in USD (American Dollar) and payment must be made in that currency. Resident rates for Kenyans and other East Africans are quoted in either USD or Ksh (Kenya Shillings).

V. Any payment made to Skyview of Africa Ltd constitutes your acceptance of the terms and conditions set out herein.

VI. All payments from our foreign clients shall be electronically wired (telegraphic transfer) to our bank accounts in Nairobi or via the credit cards specified on our website’s homepage http://localhost/skyview-final/

Local clients can make direct payments at our offices or at our bank.

VII. Upon confirming our African safari, Skyview of Africa Ltd will email the clients with an invoice showing our bank details, swift code and other relevant information. The clients shall bear the cost for the wire transfer for their bank and ours. Skyview of Africa Ltd undertakes to inform the clients in writing within 12 hours when their funds have been received at the company’s bank account.

VIII. For any payment made via a credit card, the client shall specify the type of card used and Skyview of Africa Ltd will seek specific personal details from the client to authenticate genuineness. To safeguard Skyview of Africa Ltd from fraud, our bank shall hold the client’s payment for 14 working days as it verifies the information given by the client. A 3% merchant service charge shall apply for every payment made via a credit card.

IX. Skyview of Africa Ltd will only make hotel reservations as per the safari itinerary agreed upon with the clients after our bank confirms receipt of the amount specified in the invoice. Skyview of Africa Ltd undertakes to make room reservations and pay 50% deposit/full amount (depending on the amount specified in the invoice) for the accommodation within 24 hours of receipt of the amount specified in the invoice. Skyview of Africa Ltd shall give the clients timely and regular updates on the payments for their accommodation and any other services.

IIX. Receipt of the agreed payment from the clients shall be binding to Skyview of Africa Ltd to execute the agreed itinerary.

NB: Skyview of Africa Ltd reserves the right to cancel tours if payment is not received in accordance with these terms, unless a prior agreement has been reached between the company and the clients.

2: Safari Itineraries

I. Skyview of Africa Ltd will provide a detailed safari itinerary to the clients before any payment is made to us. The itinerary shall detail the exact services to be provided and indicate all price inclusions/exclusions.

II. Skyview of Africa Ltd and its agents, in its absolute discretion, reserves the right to alter any route or other arrangements; offer equal substitutes; or to completely cancel the whole or any portion of a tour, should conditions beyond our control necessitate. The right is also reserved to decline the acceptance of any person as a member of a tour should the presence of that person be prejudicial to the good conduct of the tour, or be contrary to the prevailing laws of Kenya.

III. Due to local travelling conditions, such as the unavailability of accommodation and weather, the order of the itinerary may be altered. The conditions apply on accommodation whether we are the provider or other person or organization. Skyview of Africa Ltd is obliged to inform the clients in writing of any changes at the earliest reasonable time.

IV. It is the sole responsibility of clients to thoroughly scrutinise their African safari programme and ensure it reflects all negotiations made with Skyview of Africa Ltd and its agents. Once the clients approve the final itinerary and payment has been made, they are not a liberty to change or make any amendments to the agreed safari programme unless an agreement has been reached with Skyview of Africa Ltd. Extra cost may apply to cater for any additional services and cost. Skyview of Africa Ltd shall stick to the itinerary approved by the clients unless circumstances in (II) or (III) above applies.

3: Costs and Arrangements

I. Quoted program prices include planning, ground handling, all airport and other transfers, transport, park fees (where applicable or as specified in the itinerary), meals and accommodation as specified in the itinerary and operational charges.

II. Skyview of Africa Ltd is under no obligation to give breakdown costs involved in any escorted or tailor-made program.

4: Cancellation/No Show Fees

The following cancellation charges will be applicable. Should you need to cancel you must notify Skyview of Africa Ltd immediately in writing (or by email) for this eventuality or else your deposit will be non-refundable.

In the event of a cancellation, cancellation fees shall be applied as follows:

I. Within the period of 20 to 8 days before commencement of the safari, a fee of 30% of the total cost of the safari shall apply.

II. Within the period of 10 days before commencement of the safari, a fee of 50% shall apply.

III. Within 5 days before the commencement of the safari, a fee of 100% of the total cost of the safari.

NB: Please note different hotels have different cancellation terms and our cancellation terms above largely depend on each hotel’s cancellation policy. Some hotels and lodges do not refund payments made to them after the clients have cancelled their safari. Whenever that applies, the hotels and lodges may issue Skyview of Africa Ltd with a credit note of the same amount.

Skyview of Africa Ltd will not make any cash refunds to the clients in such circumstances and the clients will have the option of deferring their safari to a later date and the credit note will only apply to the original hotels and lodges. A deferred safari could come with additional costs due to the season of the new date of travel and other operational costs.

5: Passenger Travel Protection Programme

Our specially designed travel protection program does not provide for medical coverage and protection against lost or damaged luggage. This is, therefore, not included in the tour price and we recommend you take your own travel insurance.

6: Risk, Travel Insurance, Liability

I. Skyview of Africa Ltd  and associated companies make arrangements for hotel/lodge accommodation, for transport and conveyance by whatever means, as agents for passengers on the condition that they shall not be liable for any injury, damage, loss, accident, delay or irregularity which may be occasioned by reason of any defect in any vehicle, or through the acts or defaults of any company or person engaged in conveying the passenger or in carrying out the arrangements of the tours, or otherwise in connection therewith, or of any hotel/lodge proprietor or servant.

II. Skyview of Africa Ltd and associated companies accept no responsibility for losses or additional expenses due to delays, or changes, in train, steamer, motor, or other services, sickness, weather, strikes, civil disturbances, war, quarantine or other cause. All such losses or expenses will be passed on to tour members as these are events beyond our control. Such conveyance etc. is subject to the laws of the country in which the tour takes place and all claims are subject only to the jurisdiction of the courts of the country in which the cause of action arises.

III. Skyview of Africa Ltd reserves the right to employ sub-contractors to carry out all, or part, of the services provided and in the event of such right, the terms of clauses (i) and (ii) above relating to the company’s liability shall apply.

IV. Baggage and personal effects are carried at ‘owner’s risk’ and clients are cautioned against the risk of leaving them unattended to.

7: Limits on Skyview of Africa Ltd’s Responsibility

Skyview of Africa Ltd , its employees, shareholders, officers, directors, successors, agents and assigns (collectively Skyview of Africa Ltd ), does not own or operate any entity (except for Skyview of Africa Ltd ) which is to or does provide goods or services for your trip. It purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers (including from time to time other companies affiliated to Skyview of Africa Ltd ). All such persons and entities are independent contractors. As a result Skyview of Africa Ltd is not liable for any negligent or willful act of any such person or entity or of any third person.

In addition and without limitation, Skyview of Africa Ltd is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

There are certain inherent risks in adventure travel of the type involved here. These include, but are not limited to, risks of white water rafting, kayaking and rafting (for example dangers of rapidly moving water, rocks and other submerged objects, hypothermia, etc), horseback riding, (for example, unpredictable behavior by the horses, being spooked, etc) hiking, walking safaris, downhill or cross country skiing, (for example, equipment failures, ice or other trail obstructions) and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Passenger assumes all such risks with regard to these possibilities.

8: Complaints

Skyview of Africa Ltd and its agent (s) hope you will not encounter any problems during the holiday. However, should one arise, all complaints arising from the Africa safari or holiday shall be responded to within 48hrs of receipt and all efforts shall be made to resolve the complaint amicably.

9: International Travel Arrangements

No arrangements are made by Skyview of Africa Ltd and its agent(s) relating to the provision of international flights from any part of the world. However, we book domestic and regional flights if the safari involves flying from one region or country within Africa (if the clients want).

10: Transportation

Limousines, safari minibuses, safari land cruisers, cars, four-wheel drive vehicles or coaches will be provided according to the contract agreement to the route and the number of participants. Skyview of Africa Ltd and its agent(s) reserve the right to employ the services of sub-contractors. Multi-lingual driver guides, will be provided on request depending on the availability.

11: Photography During Travel

Skyview of Africa Ltd and its agent(s) reserve the right to take photographs during the operation of any program or part thereof and to use them for promotional purposes. By booking a program with Skyview of Africa Ltd, program members agree to allow their images to be used in such photographs. Program members who prefer that their images not be used are asked to identify themselves to their driver/guide at the beginning of their program.

12: Special Requests

Specific requests such as adjacent or connecting rooms, bedding requests, smoking or non-smoking rooms and special dietary needs should be advised at time of booking. Please note that every effort will be made to secure your special request; however, they cannot be guaranteed.
